And yet, for FTX customers, there’s an unavoidable twinge of resentment over what could have been. See here: If you had one bitcoin in an FTX account in mid-November of 2022, it was worth about $17,500. The bankruptcy managers tracked down all of FTX’s crypto and other holdings and hired an investment manager to sell them. The bull run inflated the value of FTX’s significant crypto holdings, leaving the estate with more than enough to pay back customers. Although FTX said it would have as much as $16 billion to disburse, customers and Uncle Sam get paid out first.

Bruch is one of the largest individual FTX creditors and has been tapped by the US Department of Justice to serve as one of nine on the FTX Creditors’ Committee, where he is working to recoup the funds lost by customers. DOJ-appointed creditor committees ordinarily consist of people and companies who hold the seven largest unsecured claims against the debtor (in this case, FTX), according to the agency. Before the Bell spoke with Bruch about Sam Bankman-Fried, FTX, MyPrize and the future of crypto. I feel for all of the creditors and am doing everything I can to help recoup what was taken from us. I’ve worked at some of the largest crypto trading desks in the world and then also started trading my own book of capital and grew to become one of the largest individual crypto traders.

New York CNN —A federal judge on Thursday ordered Sam Bankman-Fried to repay more than $11 billion as part of his sentence for defrauding customers and investors in his failed crypto exchange FTX. In their sentencing memorandum earlier this month, federal prosecutors laid out their reasoning for seeking $11 billion in forfeiture. Unlike restitution, where the money from seized assets goes directly to victims, the money from forfeiture is taken by the government and absorbed into the US Treasury. It is unclear how much Bankman-Fried is currently worth, but it’s likely not anywhere near $11 billion. So far, the Department of Justice has redistributed about $4 billion to Madoff’s victims.

Two years in prison for tax and securities violations. The country’s most notorious white-collar fraudsters — like Bernie Madoff and Elizabeth Holmes — have received a range of punishments for their crimes, from relatively short prison terms to effectively a life sentence. On Thursday, Sam Bankman-Fried, the onetime cryptocurrency mogul, joined their ranks, receiving a 25-year sentence for fraud, conspiracy and money laundering. In legal filings, prosecutors cited 13 examples of white-collar prosecutions that involved a loss of more than $100 million. In all but two of those cases, the defendant was sentenced to 40 years or more.

Sam Bankman-Fried, the founder of the FTX cryptocurrency exchange who was convicted of stealing billions of dollars from customers, was sentenced to 25 years in prison on Thursday, capping an extraordinary saga that upended the crypto industry and became a cautionary tale of greed and hubris. Mr. Bankman-Fried, 32, did not visibly react as Judge Lewis A. Kaplan handed down the sentence in Federal District Court in Manhattan. His parents, the law professors Joe Bankman and Barbara Fried, sat two rows from the front, staring at the floor. He knew it was criminal,” Judge Kaplan said of Mr. Bankman-Fried’s actions. Before the sentence was delivered, Mr. Bankman-Fried, cleanshaven and wearing a loosefitting brown jail uniform, apologized to FTX’s customers, investors and employees.

25 years … with caveatsBankman-Fried’s 25-year sentence is about half of the 40 to 50 years prosecutors had sought. Judge Kaplan said he weighed a number of factors, including the brazenness of the crimes and Bankman-Fried’s potential to commit crimes in the future. “It haunts me every day.”Judge Kaplan appeared unmoved by parts of Bankman-Fried’s apology about customers being hurt. FTX victims are waitingJudge Kaplan roundly rejected Bankman-Fried’s argument that there was no loss to former customers of FTX because the bankruptcy estate indicated those victims are poised to recoup most of their funds. To say that FTX customers and creditors will be paid in full “is misleading, it is logically flawed, it is speculative,” Kaplan said.

New York CNN —Sam Bankman-Fried has been sentenced to 25 years in federal prison for defrauding customers and investors in his failed crypto exchange FTX, a Manhattan court ruled Thursday. In this courtroom sketch, Sam Bankman-Fried, second from right, stands while making a statement during his sentencing in Manhattan federal court on March 28, 2024. There is no parole in federal cases, but Bankman-Fried may still be able to shave years off his term. Since 2018, however, nonviolent federal inmates can reduce their sentence by as much as 50% under prison reform legislation known as the First Step Act. In addition to the prison sentence, Kaplan also ordered a forfeiture of $11.02 billion.

Sentencing is a much more fluid process, with both sides allowed to make sweeping arguments to try to make their case to the judge. But instead, his life in recent years has been one of unmatched greed and hubris; of ambition and rationalization; and courting risk and gambling repeatedly with other people’s money,” prosecutors wrote in a memo. In a letter to the court, Marc Mukasey, the lawyer Bankman-Fried retained for sentencing, called the government’s memo “disturbing” and accused the government of trying to “break” Bankman-Fried. His behavior may come back to haunt Bankman-Fried in sentencing, Fischer said. But legal experts say that even if 100% of FTX customers get their money back, it’s not necessarily going to sway the judge to go easy on Bankman-Fried.

Federal prosecutors said on Friday that Sam Bankman-Fried, the cryptocurrency mogul who was convicted of masterminding a multibillion-dollar fraud, should receive a prison sentence of 40 to 50 years. The prosecutors outlined the recommendation in a filing in U.S. District Court in Manhattan. Mr. Bankman-Fried’s sentencing hearing is scheduled for March 28, when Judge Lewis A. Kaplan will decide his fate. “Justice requires that he receive a prison sentence commensurate with the extraordinary dimensions of his crimes,” the prosecutors said in a 116-page sentencing memo to the judge. The federal probation department separately recommended a 100-year sentence for Mr. Bankman-Fried, 32, effectively a life sentence.

New York CNN —Federal prosecutors are calling for onetime crypto billionaire Sam Bankman-Fried to be sentenced to 40-50 years in prison for stealing billions of dollars from customers and defrauding investors in his now-bankrupt crypto exchange, FTX. Bankman-Fried, who turned 32 this month, was convicted in November of stealing more than $8 billion and engaging his employees in a yearslong coverup, in what prosecutors have called one of the largest financial frauds in history. “The enormous scale of the fraud at FTX is measured not just by the amount of money that was stolen,” prosecutors said in a filing in Manhattan federal court on Friday. Under federal sentencing guidelines, Bankman-Fried could face a maximum sentence of 110 years. Bankman-Fried’s lawyer, Marc Mukasey, told CNN on Friday the defense would have a response “early next week.”

The second-largest donation in 2022 to the non-profit arm of Future Forward, the primary Super PAC supporting Biden, came from a group run by James McClave and Emily Berger. That’s more than any group other than the George Soros-linked Open Society Policy Center, which gave $15.2 million that year. That trend is set to continue this year: Future Forward has announced plans to run the largest ever political advertising campaign by a Super PAC in 2024. A spokesperson for Future Forward did not respond to a request for comment. The pro-Biden group Future Forward has said it plans to run the largest political advertising campaign by a Super PAC this year.

The comeback is a reversal of fortune from more than a year ago, when the value of cryptocurrency cratered as Sam Bankman-Fried’s exchange, FTX, collapsed almost overnight. Many investors lost billions, and intensified government scrutiny of the industry fueled doubts about its existence. Some wondered anew: If digital currency isn’t backed by another asset, is it really worth anything?

Under federal sentencing guidelines, he could face a maximum of 110 years. In the memo, Bankman-Fried’s lawyer, Marc Mukasey, asks the judge overseeing the case to reject the pre-sentencing report prepared by the Probation Department, which recommends a 100-year sentence. Considering Bankman-Fried’s “charitable works and demonstrated commitment to others” Mukasey recommends a prison sentence between five and six-and-a-half years. The judge overseeing the case, Lewis Kaplan of the Southern District of New York, will weigh several factors in deciding Bankman-Fried’s sentence, including arguments from prosecutors, defense counsel and the recommendations from the Probation Department. Typically, in white-collar crimes, the bigger the financial loss, the longer the sentence.

Since Sam Bankman-Fried was convicted of fraud last year, he has hired a new lawyer known for courtroom showmanship. A group of sympathetic law professors has pushed for a reappraisal of his actions. And his parents have turned for help to former employees of FTX, the collapsed cryptocurrency exchange he founded. From a federal detention center in Brooklyn, Mr. Bankman-Fried, 31, has continued to fight his case behind the scenes, as he argues for a lenient sentence and prepares to appeal his conviction. Trump, to oversee his sentencing, as well as a separate lawyer at the law firm Shapiro Arato Bach to handle the appeal.

When the cryptocurrency exchange FTX declared bankruptcy about 15 months ago, it seemed few customers would recover much money or crypto from the platform. Well, it turns out, FTX lawyers told a bankruptcy judge this week that they expected to pay creditors in full, though they said it was not a guarantee and had not yet revealed their strategy. The surprise turn of events is raising serious questions about what happens next. Among them: What does this mean for the lawsuits FTX has filed in an attempt to claw back billions in assets that the company says it’s owed? Will the possibility that customers could be made whole be raised at Bankman-Fried’s sentencing?

Binance is exiting the US as part of the agreement the crypto exchange made with law enforcement agencies. There is even a National Cryptocurrency Enforcement Team within the Justice Department actively identifying and investigating criminal cases involving digital assets. NEW YORK, Nov 21 (Reuters Breakingviews) - Cryptocurrency is a precocious industry, in its lows as well as its highs. So it makes sense that Binance, the world’s largest crypto exchange, has agreed to pay a $4.3 billion fine for anti-money laundering, effortlessly surpassing penalties paid by miscreant financial firms that have been around for more than a century longer. Binance boss Changpeng Zhao, a kingpin of crypto and the man who precipitated the downfall of bankrupt rival FTX, pleaded personally guilty on Tuesday to criminal violations. HSBC (HSBA.L), (0005.HK) in 2012 agreed to pay $1.9 billion for its role in facilitating drug cartels’ money laundering. Shortly before Mr. Bankman-Fried’s verdict landed on Nov. 2, the price of Bitcoin surpassed $35,000, its highest level since an industry meltdown in 2022. Crypto investors are growing optimistic that the Securities and Exchange Commission will approve an exchange traded fund, or E.T.F., that tracks the price of Bitcoin, analysts said. The fund would trade on traditional stock exchanges and offer an easy way for people to invest in cryptocurrencies, potentially bringing a wave of money into the industry. that seemed to pave the way for it to offer the Bitcoin product. And last week, BlackRock, a giant money manager, filed paperwork to establish a similar E.T.F.

Under the Biden administration, Mr. Garland and Deputy Attorney General Lisa Monaco have made several overlapping efforts in this area. Mr. Bankman-Fried’s case was highly unusual, in large part because he became remarkably prominent in political circles and among certain members of the media. We can hire more qualified investigators and prosecutors in Washington to pursue these cases. Policy and organizational changes within the Justice Department may help a bit, but just as important (if not far more so), we also need to ensure that U.S. attorney’s offices and F.B.I. Ideally, Congress would do its part by significantly increasing funding for hiring more prosecutors, investigators and support staffs, and by committing to this effort as a yearslong national priority.
